1. Introduction
The information text you are about to read has been prepared by PATRION ADVANCED TECHNOLOGIES INC. (hereinafter referred to as "Patrion" or "Company") as the data controller in accordance with Article 10 of the Personal Data Protection Law No. 6698 (KVKK) and taking into account the Communiqué on the Procedures and Principles to be Followed in Fulfilling the Obligation to Inform. We are announcing this information text and necessary explanations to our users.
Our Company reserves the right to make necessary updates to this information text within the framework of the law. As a Company with data controller status, we value and respect the personal data, privacy, and security of users visiting our site, and we desire to fulfill our responsibilities in accordance with the KVKK. For this reason, we will explain the purposes of processing your personal data, the method and legal reasons for data collection, and what your rights are as listed in Article 11 of the KVKK.
2. What is Personal Data?
Personal data is defined in the Personal Data Protection Law No. 6698 as "any information relating to an identified or identifiable natural person." As understood from the definition, any information that makes you identifiable is personal data. In addition to all these, political opinion, sect, race, religion, association-foundation membership, health information, philosophical thought, belief, sexual preference, criminal record, criminal conviction information, and biometric data are special categories of personal data.
3. Legal Basis
The Personal Data Protection Law No. 6698 stipulates that individuals whose data is processed must be informed before data processing activities are carried out. This matter, referred to as the Obligation to Inform, is stipulated in Article 10 of the Personal Data Protection Law as follows: "The data controller and the person authorized by the data controller are obliged to inform the relevant persons about; the identity of the data controller and, if any, its representative, the purpose for which personal data will be processed, to whom and for what purpose the processed personal data can be transferred, the method and legal basis of personal data collection, and other rights listed in Article 11."
The data controller is defined in Article 3 of this Law as "natural or legal persons who determine the purposes and means of processing personal data and are responsible for establishing and managing the data recording system." Again, the data processor is defined as "the natural or legal person who processes personal data based on the authority given by the data controller on behalf of the data controller." 4. Purposes of Processing Your Data
First of all, we would like to state that; your personal data may be processed by Patrion in accordance with the provisions of the Personal Data Protection Law No. 6698, in line with the explicit consents received from you. However, we would also like to remind you that consent from individuals is not required when the situations listed in Article 5/2 of the Personal Data Protection Law are in question.
The personal data collected by us generally includes identity, contact, personal, financial, audio and visual recordings, customer transaction information, bank information, address, and data you provide in the contact application form. Personal data obtained from you is processed in accordance with the provisions of the KVKK for the following purposes:
- To provide information when requested by Courts and Authorized public institutions and organizations
- To fulfill our legal obligations, to follow up legal affairs, and to exercise our rights arising from the legislation in force
- To contact the addressee during the management of goods purchase and sales processes, to return to the customer based on the sales contract, to respond to customer complaints and suggestions
- To inform you about our changing and developing products and services and to provide necessary information when required
- To identify personal needs and usage purposes, and in this context, to provide special goods and services to you, our customers
- To improve goods and services offered over the internet as PATRION
- To ensure information security and to quickly resolve any problems
- To contact those who submit requests and complaints to PATRION
These processes are carried out in accordance with the principle of honesty and in line with the provisions of the KVKK.
5. Method and Legal Basis of Collecting Your Data
Your personal data is collected and processed in accordance with all legal regulations, especially the KVKK, for the purposes mentioned above, based on explicit consent or in cases where the law does not require explicit consent, by means of your accessing our website, becoming a member of our website, shopping from our website, or filling out the contact form to get in touch. We would also like to point out that with technological developments, the collection of data may also be possible through automatic or non-automatic ways in the internet environment.
6. Transfer and Protection of Your Data
First of all, your personal data is secure with our Company. We do not share this data with third parties without your explicit consent. However, we have an obligation to share with third parties and institutions as required by law and regulations. Even in these legally required sharing, we take the necessary technical, administrative, and legal measures to prevent the violation of your rights. We attach importance to confidentiality even during this transfer. Again, your personal data that you provide to our company is transferred to our business partners, service providers, suppliers, group companies, company officials, and company shareholders, and authorized public institutions and organizations and private legal entities in accordance with the conditions set out in Articles 8 and 9 of the KVKK for the purposes mentioned above.
The Personal Data Protection Law No. 6698 primarily aims to protect data and prevent unauthorized transfer. As PATRION, we take the necessary technical and administrative measures to prevent the transfer of data to unauthorized third parties, in accordance with the relevant law provisions. In this context, we are particularly adapting our company policies to comply with the Personal Data Protection Law and we have all kinds of technical software and hardware for the protection of personal data within our organization.
7. Storage of Your Data
Your personal data will be processed and maintained within the scope of Article 5 of the Personal Data Protection Law No. 6698, under the legal exceptions stated above. In this context, personal data will be stored for the period required by the processing purposes mentioned above. In addition, PATRION may store personal data for the periods of limitation determined in accordance with the legislation, limited to the purpose of making the necessary defenses in case of any dispute that may arise between the Data Subjects and PATRION.
8. Your Rights Regarding the Processing of Your Data
Article 11 of the Personal Data Protection Law No. 6698 has stipulated the rights of the data subject. In the law, the data subject is referred to as the "relevant person"; and the right to make certain requests regarding the processing of their data is envisaged. According to this article, the request rights of the relevant person are as follows:
a. To learn whether personal data is processed or not,
b. To request information if personal data has been processed,
c. To learn the purpose of processing personal data and whether they are used in accordance with the purpose,
d. To know the third parties to whom personal data is transferred at home or abroad,
e. To request the correction of personal data if it is incomplete or incorrectly processed,
f. To request the deletion or destruction of personal data within the framework of the conditions stipulated in Article 7 of the Law titled "Deletion, destruction or anonymization of personal data",
g. To request that the correction of incomplete or incorrect data, or the deletion or destruction of data upon the request of the relevant person, be notified to third parties to whom personal data has been transferred,
h. To object to the emergence of a result against the person himself by analyzing the processed data exclusively through automated systems,
i. To request the compensation of the damage in case of loss due to unlawful processing of personal data.
You can submit your requests regarding your rights arising from the Personal Data Protection Law, which are explained above, to our company within the framework of the procedure specified in this Information Text. Your requests will be answered by PATRION as soon as possible or within thirty days at the latest. Applications must be made by the data subject himself. PATRION will only consider the application made by the data subject and will share information about the applicant.
